Important Notice

This agreement contains a binding arbitration clause and class action waiver that affect your legal rights. Please read this agreement carefully before using our Services.

 

We provide medical care in the Commonwealth of Virginia, specifically in Virginia Beach, VA. If you are experiencing a medical emergency, dial 911 immediately. Seriously Health does not provide emergency or urgent care services.

1. Acceptance of Terms

These Terms and Conditions (“Terms”) are entered into by and between you and Seriously Health, LLC, a Virginia-based medical practice located in Virginia Beach, VA ("Seriously Health", "we", "us", or "our"). These Terms govern your access to and use of our website, services, and digital tools (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.

2. Seriously Health Services

2.1 Scope of Services

Seriously Health, LLC provides medical weight loss care by licensed healthcare providers. Services may include:

  • Initial and follow-up consultations

  • Health assessments and lab evaluations

  • Prescription and medication management

  • Lifestyle and nutrition counseling

All services are currently provided exclusively within the state of Virginia and are in-person or telehealth-based for Virginia residents.

Seriously Health complies with all HIPAA privacy and data protection regulations.

2.2 How the Services Work

You may schedule appointments directly with our staff or via our online booking system. A 50% deposit is required to confirm appointments.

If you have not been seen for more than six (6) months, your next visit will be scheduled as an initial consultation to re-establish care.

3. Privacy

We take privacy seriously. Seriously Health, LLC adheres to all provisions under the Health Insurance Portability and Accountability Act (HIPAA). Patient information is encrypted, stored securely, and accessed only by authorized personnel.

4. Eligibility and Account Creation

You must be at least 18 years old and a resident of Virginia to consent for Seriously Health Services. We do not accept any type of insurance as a form of payment.

Account creation may be required for telehealth visits. You agree to provide accurate, complete, and updated information and to keep your credentials secure.

5. Fees, Refunds & Cancellation Policy

5.1 Zero-Commitment Policy

Seriously Health does not use subscriptions or auto-payments. You are never locked into a recurring plan.

5.2 Appointment Deposits

  • All bookings require a 50% deposit.

  • Deposit is applied toward your visit total.

  • Remaining balance is due at the time of service.

5.3 Rescheduling & Cancellations

  • You may reschedule or cancel free of charge with more than 24 hours’ notice.

  • If you cancel or no-show within 24 hours, your 50% deposit is forfeited.

5.4 Medication Refunds

Due to medication safety regulations, we cannot refund or accept returns on any prescription medications once ordered or delivered—even if unopened.

5.5 Stopping the Program

If you stop the program for financial or personal reasons, you may do so at any time. However, past visits are non-refundable.

6. Modifications to Terms and Services

We may update these Terms from time to time. Updated Terms will be posted with a new “Last Updated” date. By continuing to use the Services, you agree to the revised Terms.

We may modify or discontinue any part of the Services at our discretion without liability.

7. Proprietary Rights

All content and materials on the Seriously Health website and platforms, including text, logos, graphics, videos, and software, are owned or licensed by Seriously Health, LLC and are protected by intellectual property laws. You may not copy, reproduce, or distribute them without written permission.

8. Code of Conduct

You agree not to:

  • Provide false information or create fake accounts

  • Violate privacy or intellectual property rights

  • Use the Services for illegal purposes

  • Attempt to hack, disrupt, or misuse the platform

Violation may result in termination of access and legal action.

9. Third Party Links and Services

We may link to third-party websites, labs, or pharmacies for convenience. We are not responsible for the content, accuracy, or practices of these external providers.

10. Disclaimers

The Services and all associated content are provided “as is” without warranty. We do not guarantee uninterrupted access or outcomes. You agree to use the Services at your own risk.

We are not liable for any damages, including lost profits or data, due to the use of our Services.

11. Limitation of Liability

Our liability to you is limited to the amount you paid for Services in the last six (6) months or $100, whichever is lower. This limitation applies to any claim, whether contractual, tort-based, or otherwise.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Commonwealth of Virginia. Any legal action must be filed in a court located in Virginia Beach, VA.
